This privacy policy (“Privacy Policy”) is part of our terms of service, which are provided to you when you purchase from Etain in its dispensaries.  This Privacy Policy describes how Etain, LLC (“Etain”) collects, uses, maintains and discloses the information, including personally identifying information  (“PII”) provided by users of its website www.etainhealth.com (the “Site”) and Etain’s products (the ”Products”). 

This Privacy Policy explains how information that you provide on this Site, including personally identifying information, is collected, used and/or disclosed.  Etain understands how important your privacy is to you and we will not share your PII with any third parties except as delineated in this Policy.

Collection of customer-provided PII.

When you contact Etain, register to receive information via any electronic method, including email, text, or instant message, or order something from our Site, we may collect the PII you provide us, including your name, address, telephone number, email address; Products ordered, as well as any other information that you directly and voluntarily provide Etain. You may always decline to provide such information, with the understanding that it may prevent you from using the Site, or using all the features of the site, or receiving responses to your inquiries or other information of interest. Etain uses commercially reasonable data collection, storage and processing practices to protect Site-disclosed PII from unauthorized disclosure or access.

Additionally, when you enter Etain’s retail stores, you will be asked to provide a valid driver’s license or government issued identification to confirm your identity and that you are at least 21 years of age (or you are a medical patient with a valid certificate issued by an authorized practitioner). Your identification must be verified by our staff before you can shop at our store. You may choose to present your identification for verification in two ways: (1) your identification card can be scanned for validation, or (2) if you prefer not to have your identification scanned, you can present your identification to our staff for manual validation. If you have your identification scanned, you are authorizing us to collect certain information including your name, driver’s license number, and the address listed on your identification.

Collection of non-PII provided by customers.

In order to enhance and improve our service, the Site and our customers’ experience, Etain may automatically collect non-PII about you when you interact with our Site.  Such information may include customer browser, computer and operating system information, demographic data, and historic Site use data.  Etain may also use “cookies,” which is data passed from your browser to the Site.  Cookies are used to track data and Site usage, and you may decline to accept them.  Please understand that if cookies are declined, all portions of the Site may not fully operate.

Policy scope.

By using the Site, you agree to be bound by and comply with this Privacy Policy. However, once you leave the Site, even if via redirection to a third-party website or application via clicking a link on the Site, you are no longer governed by this Policy or our terms of service. Etain is not responsible for the privacy or other practices of other sites other than the Site.

Site use and information regarding minors.

Etain does not permit the use of the Site by persons who are under the age of eighteen (18) years, and it does not collect information as to such persons.  If Etain learns that any Site user is a minor, it will promptly delete any PII associated with that customer.  We ask that no PII be provided to us on the Site as to any minor, although a non-minor caregiver may provide his or her own PII in the course of caring for a minor.

Retention of information.

Etain is under no affirmative obligation to retain information collected from the Site for any specific period of time and will retain information for a period of time that it believes to be useful.  Etain does not trade in, or sell or otherwise transfer for gain any customer PII derived from our Site to any third parties, although it may engage third-party companies to assist it in analyzing the ways in which our customers use the Site.

However, customer PII provided to the Site may be disclosed to a third party if Etain is mandated to do so via a legal requirement, such as a statute, regulation, or court order, or if such information is necessary in support of a criminal or legal investigation or action.

Policy updates.

When this Privacy Policy is updated or changed, the date of last amendment shall be noted at the top of this page. Etain reserves the right in its sole discretion to amend this Privacy Policy at any time.  Changes to this Policy take effect immediately upon their posting on the Site, which shall constitute the only notice of the same.  We suggest that Etain customers review this Policy at regular intervals to ensure that they are aware of the current terms.  This Privacy Policy shall apply to any other Etain websites that may explicitly post this Policy, via link or otherwise.

Transfer of information to corporate successors.

If Etain is restructured, acquired or merged with another company, or in the event of insolvency or dissolution, your information may, to the extent permitted by law, be transferred to the new owners as a business asset. If that occurs, such acquiring company acquires will also assume the rights and obligations regarding your PII as described in this Policy. 

Withdrawal of consent.

By providing us your email address and opt-in for additional information about us and our products, you are granting us permission to send you emails about our Company, new products and other updates. You may stop these emails at any time thereafter by clicking the “Unsubscribe” link at the bottom of each email.

Alternatively, you may email your request that we discontinue contacting you via email, or even request deletion of your PII stored by Etain, if any, by contacting us at privacy@etainhealth.com or mailing your request to:
